      <title>Accident Leaves Vehicle Wedged Between Two Toll Lanes</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;A &lt;a href="http://www.nwfdailynews.com/news/lanes-17504-tollbooth-wedged.html"&gt;two-car accident&lt;/a&gt; on Saturday left a vehicle wedged on its side between two tollbooths.&lt;/p&gt;
&lt;p&gt;Carrie Anne Dolamore, 32, of Pensacola, was driving south toward the Garcon Point Bridge Plaza in the inside lane when she abruptly switched lanes, according to Florida Highway Patrol.&lt;/p&gt;
&lt;p&gt;The other driver, Gerald A. Henrikson, saw Dolamore&amp;rsquo;s vehicle coming toward him head on and was able to stop his vehicle. Dolamore's vehicle swerved left, bouncing off two barriers before rolling onto its die and becoming stuck between both toll lanes.&lt;/p&gt;
&lt;p&gt;Henrikson was not injured in the crash and Dolamore was taken to the hospital with minor injuries.&lt;/p&gt;
&lt;p&gt;Pending blood work results, Dolamore may be charged in the crash.&lt;/p&gt;

      <title>Washington Ruling Bad for Asbestos Victims</title>
      <description>&lt;p&gt;The Supreme Court of Washington State has issued two bad rulings for asbestos victims, in the cases of Braaten v. Saberhagen and Simonetta v. Viad Corporation. the gist of these ruling is that equipment manufacturers who supplied equipment that was known by them to utilize asbestos products in its final use and installation would no be held liable for the injuries (like mesothelioma cancer) caused by the asbestos. The court overlooked the reasoning of other courts that have addressed this issue favorably for the Plaintiffs. Also overlooked is the abundant evidence already of record in numerous cases that these manufacturers knew of the dangers, ofter supplied or instructed on the use of asbestos products and failed to warn user of their equipment of the dangers.&lt;/p&gt;
&lt;p&gt;It is well documented that there was an industry-wide conspiracy of silence regarding the dangers of asbestos for many years. while the companies now receiving amnesty in Washington State may not have always been the main players in the conspiracies, they were nonetheless some of the main beneficiaries of it.       <title>Mesothelioma Treatment</title>
      <description>&lt;p&gt;With all the lawyer ads on mesothelioma it is easy to overlook some of the strides that are being made in the treatment of this asbestos related cancer. Clinical trials now underway are investigating a number of &amp;quot;targeting drugs&amp;quot;. Targeted drug therapy tries to attack specific features within cancer cells. Targets being studied in these trials include a substance that cancer cells make to build new blood vessels to bring the cancer cells nutrients and oxygen. Another target is an enzyme that helps cancer cells develop resistance to chemotherapy drugs. Researchers hope drugs that target these areas can help kill mesothelioma cells. Patients with mesothelioma may be interested in clinical trials for a chance to try new types of treatment. Of course a cure isn't guaranteed. Everyone is encouraged to consider all treatment options and your doctor may tell you what clinical trials are possible for you. Current clinical trials may help doctors better understand how to treat mesothelioma in the future.&lt;/p&gt;

      <title>McCain Picks Palin</title>
      <description>&lt;p&gt;Hard to stay away from politics. McCain's pick of Palin is obviously good for Obama. Picking a woman despite her lack of experience looks like a desperate trick. Surprise! Of course, this is not the first time McCain has picked a younger woman. Who are we to stand in the way of true love? In this case, the true love is for her ties to the oil companies that want to buy this election like they bought the last two. Who would have figured that putting two oil men at the top of our government would result in huge profits for big oil and no-bid contracts for Halliburton. Well, I guess now we all know when we drive up to the pump.&lt;/p&gt;

      <title>Highpoints at the Democratic Convention</title>
      <description>&lt;p&gt;Departing from my usual topics, I will point out the obvious, trial lawyers are watching this election closely and cannot afford another Republican administration. If you think the Bush judges will ultimately give you justice when you or a family member are injured or killed by corporate negligence, you are wrong. Many Bush appointees only care about servicing the most powerful and are ideaological in their results and opinions. No matter how innocent you are and how bad the company was, ideological judges just don't care, they only want the result that will keep them in positions of power and influence, and that doesn't mean helping out the average citizen. &lt;/p&gt;

      <title>Undue Influence in West Virginia</title>
      <description>&lt;p&gt;A recent &lt;a href="http://www.nytimes.com/2008/08/13/us/13lawsuit.html?_r=1&amp;amp;amp;scp=1&amp;amp;amp;sq=west%20virginia%20governor&amp;amp;amp;st=cse&amp;amp;amp;oref=slogin" target=_blank&gt;New York Times article &lt;/a&gt;exposed how a major corporation has access to governmental favors not enjoyed by ordinary citizens. In a lawsuit currently on appeal to the Supreme Court of West Virginia, the article explains, Dupont had direct access and meetings with the state's governor. Doing a favor for Dupont, the governor's office filed its own brief in the appeal, even though the state is not a party to the action. This is an unusual step, but it was obviously designed to curry favor with Dupont and other polluters who don't want to be held liable for the damage they have caused. One of Dupont's employees now working for the governor was involved.       <title>FDA Had Warned Digitek Maker - Where was the follow up?</title>
      <description>&lt;p&gt;&lt;span class=234441719-29052008&gt;&lt;font face=Arial size=2&gt;Researchers have found a warning letter from all the way back in 2006 that the FDA's parent agency Health and Human services had warned the makers of the now-recalled heart medication back in 2006 of problems with their manufacturing facility. Specifically citing Digitek (as Digoxin) along with other substances produced at their New Jersey facility, the letter note a specific lack of oversight as regards product strength. Now we know that the pills were almost 2 times the size they should have been and we are hearing from a lot of patients about the serious injuries they suffered while on the bad pill. Many first learn of the problem when the get the recall letter from their pharmacy.       <title>Digitek Recall shows FDA Inept</title>
      <description>&lt;p&gt;&lt;p class=MsoNormal style="MARGIN: 0in 0in 0pt"&gt;&lt;font face="Times New Roman" color=#000000 size=3&gt;The FDA appears late to the party again. This time widely prescribed piolls were made too large and so they had, you guessed it, too much of the medication in each dose.&lt;/font&gt;&lt;/p&gt;
&lt;p class=MsoNormal style="MARGIN: 0in 0in 0pt"&gt;&lt;font face="Times New Roman" color=#000000 size=3&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;Digitek pills manufactured by Actavis Totowa, distributed by Mylan Pharmaceuticals and sold under the labels “Bertek” or “UDL” have been recalled because they may contain double the dose of the active ingredient.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;Digitek is used to treat heart failure and abnormal heart rhythms. Tablets with twice the appropriate dose pose a risk of digitalis toxicity, symptoms of which include nausea, vomiting, dizziness, abnormal vision, low blood pressure, cardiac instability, slow heart rate and even death. Individuals with poor renal function are particularly susceptible to digitalis toxicity.&lt;/font&gt;&lt;/p&gt;
&lt;p class=MsoNormal style="MARGIN: 0in 0in 0pt"&gt;&lt;font size=3&gt;&lt;font color=#000000&gt;&lt;font face="Times New Roman"&gt;&lt;span style="mso-tab-count: 1"&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;It is not yet known how many lots may have been affected so all lots are subject to this recall.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;Those suffering from digitalis toxicity may experience severe flu-like symptoms and, depending on the severity, may require hospitalization and intensive medical intervention.&lt;/font&gt;&lt;/font&gt;&lt;/font&gt;&lt;/p&gt;

      <title>Judge Decries Preemption</title>
      <description>&lt;p&gt;Finally, a beautiful and succinct&amp;nbsp;statement from a Federal Judge on the real nature of the move to preempt state courts from having pharmaceutical liability lawsuits..&amp;nbsp;The two page&amp;nbsp;Order is making the rounds among plaintiffs' attorneys, reassuring us that someone understands that Federal Preemption&amp;nbsp;in drug&amp;nbsp;cases is nothing less that an outright power grab&amp;nbsp;by the federal government, brought to us by the party that used to advocate, hypocritically it appears, for the expansion of states' right and the diminishment of Federal power. Judge Wilson's supplement to his previous order denying preemption in the Prempro litigation is direct and&amp;nbsp;to the point: "It appears to me that the expansive reading of preemption is part of an "overall assault on the citadel of the right to trail by jury'"&amp;nbsp;(Quoting Cardozo). The Order also refers to this assault as "backdoor federalization." This is clearly true in light of the fact that there is nothing in the FDA enacting&amp;nbsp;legislation that says state action (including state jury trials)&amp;nbsp;is preempted. There is extensive history and precedent&amp;nbsp;that there is no such preemption, but the Bush packed FDA (haven't they have done a great job by the way) ignored all that and issued a preamble to recent regulations (they couldn't get it to pass through standard rule procedures) saying the FDA now wants preemption.&amp;nbsp;&amp;nbsp;They want&amp;nbsp;no state&amp;nbsp;to determine by jury trial or otherwise that a drug manufacturer was negligent in the marketing of its products.&amp;nbsp;The powers that be&amp;nbsp;seem intent on getting this piece of corporate payback through&amp;nbsp;the courts, so unless we get a president who understands this injustice, the right to jury trial will no doubt&amp;nbsp;be trampled by our U.S. Supreme Court.&lt;/p&gt;&lt;a href="http://pensacola.injuryboard.com/fda-and-prescription-drugs/judge-decries-preemption.aspx?googleid=237100"&gt;Originally posted&lt;/a&gt; at &lt;a href="http://www.InjuryBoard.com"&gt;InjuryBoard&lt;/a&gt; by &lt;a href="http://www.injuryboard.com/Robert-Blanchard/"&gt;Robert Blanchard&lt;/a&gt;</description>

      <title>Three Injured in Pensacola Car Accident</title>
      <description>&lt;p&gt;A &lt;a href="http://www.pensacolanewsjournal.com/apps/pbcs.dll/article?AID=/20080307/NEWS01/803070340/1006"&gt;car accident&lt;/a&gt; in Pensacola on Thursday sent three people to the hospital.  The accident involved two cars traveling on Mobile Highway.   One car flipped and landed on top of the other car.  &lt;/p&gt;&lt;p&gt;The first &lt;blockquote&gt;car was stopped, facing west on Boulder Avenue, then pulled out into the path of McClain's vehicle, which was traveling north on Mobile Highway, troopers said. McClain's vehicle collided with the driver's side of Wiseman's vehicle, causing it to skid sideways and flip.&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;There were two people in the first car and one in the second.  They were all taken to Sacred Heart Hospital to be treated for their injuries.  Two of the people were listed in serious condition.
